This is a much-needed reissue of the standard English translation of Hegel's Philosophy of Nature, originally published in 1970. The Philosophy of Nature is the second part of Hegel's Encyclopaedia of the Philosophical Sciences, all of which is now available in English from OUP. Hegel's aim in this work is to interpret the varied phenomena of Nature from the standpoint of a dialectical logic. Those who still think of Hegel as a merely a priori philosopher will here find abundant evidence (...) that he was keenly interested in and very well informed about empirical science. The Philosophy of Nature is integral to his philosophical system and deserves the most serious attention. Students and scholars of Hegel and the history of European philosophy will welcome the availability of this important text, which also includes a translation of Hegel's Zusatze or lecture notes. Ist es moralisch verantwortbar, Menschen mit technischen Eingriffen zu verbessern? Der Aufsatz versucht diese Frage zu beantworten, indem zwei Gefahren für Verbesserungswillige beleuchtet werden: der Verlust der Menschlichkeit und der unerwünschte Wandel der individuellen Persönlichkeit. Sodann wird ein „Liberalismus mit Auffangnetz“ als Lösung des Problems vorgestellt, die eine unterschiedliche Bewertung von reversiblen und irreversiblen Eingriffen vornimmt. Im letzten Schritt wird überprüft, wie weit diese Konzeption auch anwendbar ist, wenn Eltern ihre Kinder verbessern lassen wollen, also ein „informed consent“ nicht vorausgesetzt (...) werden kann. Dabei werden Argumente zurückgewiesen, die Habermas gegen eine Verbesserung von Kindern vorgebracht hat. (shrink)

Am 1. Februar 2010 ist das Gendiagnostikgesetz (GenDG) in Kraft getreten. Die Debatte um einige Regelungsbereiche, wie beispielsweise das Neugeborenenscreening, reißt nicht ab. Ein Aspekt des Gesetzes ist im Rahmen der Debatte um die Präimplantationsdiagnostik (PID) in Deutschland unter neuen Vorzeichen zu diskutieren: Das – international bislang einzigartige – Verbot der pränatalen Diagnostik so genannter spätmanifestierender Erkrankungen, die erst nach der Vollendung des 18. Lebensjahres ausbrechen. In diesem Beitrag möchten wir Hinweise zur differenzierten Diskussion dieser in § 15(2) GenDG bestimmten (...) Verbotsnorm liefern. Obgleich Argumente, insbesondere das Recht auf Nichtwissen des geborenen Kindes, für ein solches Verbot sprechen, kommen wir aufgrund der medizinischen Sachlage und nach einer Analyse der Pro- und Kontraargumente aus ethischer und rechtlicher Sicht zu dem Schluss, dass ein generelles Verbot der pränatalen Diagnostik spätmanifestierender Erkrankungen im Sinne der Zielsetzung womöglich insuffizient ist sowie in der Begründung Inkonsistenzen zum bereits bestehenden Regelwerk aufweist, und lenken daher den Blick auf unter Umständen bessere Alternativen. Caregivers should usually accede to parents’ requests for life-sustaining treatment. For such decision-making, the best interests standard is too limited. John Arras’s “relational potential standard,” con-joined to a contemporary care ethics framework, provides a better guide.

Für die Argumentation von Moralphilosophen, die die Legalisierung der aktiven Sterbehilfe befürworten, spielt das Autonomieprinzip eine wichtige Rolle. Ihrer Auffassung nach verlangt der Respekt vor der Autonomie, die Entscheidung eines schwer kranken Menschen gegen die Fortsetzung des Lebens vorbehaltlos anzuerkennen. Dagegen haben verschiedene Theoretiker auf Gefahren hingewiesen, die die rechtliche Zulassung der Tötung auf Verlangen für die individuelle Autonomie mit sich bringt. Sobald der Kranke über die Möglichkeit der aktiven Sterbehilfe verfüge, falle ihm die Verantwortung für die Inanspruchnahme von Pflegeleistungen (...) zu. In der Folge könne u. a. von Seiten der Familie die Forderung an ihn gestellt werden, den vom Gesetzgeber eröffneten Ausweg zu nutzen und sie von der Last seiner Pflege zu befreien. Die Bedenken erscheinen insofern berechtigt, als Formen sozialen Zwangs vorstellbar sind, die eine freie Entscheidung des Patienten verhindern. Allerdings vermag weder das Verbot noch die Zulassung der aktiven Sterbehilfe eine autonome Entscheidung aller Individuen zu gewährleisten. Die Abwägung der Risiken, mit denen beide Optionen behaftet sind, spricht im Ergebnis für die Legalisierung der Tötung auf Verlangen. (shrink)

This paper addresses the just distribution of vaccines against the SARS-CoV-2 virus and sets forth an ethical framework that prioritises frontline and essential workers, people at high risk of severe disease or death, and people at high risk of infection. Section I makes the case that vaccine distribution should occur at a global level in order to accelerate development and fair, efficient vaccine allocation. Section II puts forth ethical values to guide vaccine distribution including helping people with the greatest need, (...) reducing health disparity, saving the most lives and promoting narrow social utility. It also responds to objections which claim that earlier years have more value than later years. Decisions regarding life-sustaining medical treatments for young children with profound disabilities can be extremely challenging for families and clinicians. In this study, Brick and colleagues1 surveyed adult residents of the UK about their attitudes regarding withdrawal of treatment using a series of vignettes of infants with varying levels of intellectual and physical disability, based on real and hypothetical cases.1 This is an interesting study on an important topic. We first highlight the limitations of using these survey data to inform public (...) policy and then offer a different interpretation from the authors’ regarding their findings about the value the public appears to place on relational capacity. The authors asked members of the lay public to interpret a disabled child’s best interest in a series of vignettes. The respondents were 92% white; 59% were atheist or reported no religious affiliation. Though the authors note this lack of diversity as a limitation, we would add that this limitation is particularly problematic in this context. Minority views on this issue may differ significantly from the majority perspective. When the stakes are high, use of public opinion data to directly inform policy requires, at a minimum, a representative sample reflecting both the true diversity of views within the public and a method to justly account for the alternate views of the minority. Vor diesem Hintergrund könnte es durchaus nützlich sein, die Erkenntnisse der Wissenschafts- und Technikforschung zur Genese und Entwicklung neuer Techniken auszuschöpfen. Dies erscheint gerade auch für die ins Phantastische weisende Zukunft der Individualisierung medikamentöser Therapie, wie man ihr häufig in der Beschreibung pharmakogenetischer Behandlungskonzepte begegnet, angebracht. Techniken, die sich noch im Entwicklungsstadium befinden und deren breite Anwendung noch einige Jahre auf (...) sich warten lassen wird, sollten sehr sorgfältig auf ihren Realitätsgehalt und das zu erwartende Leistungspotenzial hin analysiert werden. Dazu gehört v. a. auch eine kritische Auseinandersetzung mit den Leitbildern, Visionen und Nutzenversprechen, mit denen technische Innovationen oft sehr absichtsvoll ausgestattet werden. Wird dabei die Distanz zur Rhetorik der Protagonisten der neuen Techniken nicht gewahrt, gerät die ethische Reflexion unvermittelt in die Rolle, profane Marketingstrategien wortgewandt und ideenreich zu veredeln. Research evidencing the consequences of the experience of ‘calling’ have multiplied in recent years. At the same time, concerns have been expressed about the conceptual coherence of the notion as studies have posited a wide variety of senses in which both workers and scholars understand what it means for workers to be called, what they are called to do and who is doing the ‘calling’. This paper makes both conceptual and empirical contributions to the field. We argue that Bellah et (...) al.’s (Habits of the heart: Individualism and commitment in American life, University of California Press, 1996) contrast between tradition-based and expressivist understandings of ‘calling’ highlights a fundamental but neglected fissure in the literature. Expressivist accounts amongst both scholars and research participants require only that ‘calling’ be deeply felt by those who experience it. However, tradition-based accounts require an external caller. Exemplifying this, workers who attest to a divine call and scholars who write about ‘calling’ in the context of particular Christian traditions understand ‘calling’ in terms of a relationship with God. These accounts cannot but be in radical tension. We suggest that this conceptual confusion can be understood in terms of MacIntyre’s notion of ‘tradition-constituted rationality.’ The implications of this argument for practice are evidenced in our report of a study of adherents to one such tradition, workers at a Christian organization that supports people in poverty. Through in-depth interviews with long-term volunteers, we seek to assess if tradition-based ‘calling’ can be evidenced in unpaid work for the lack of pay and career progression opportunities strongly suggest the presence of ‘calling.’ This study demonstrates that even in the context of work that exhibits duty and altruism associated with expressivist accounts of ‘calling,’ these workers’ understanding of the relationships between themselves, their clients and Jesus Christ dominate their work choices. It is the meaning derived from a divine caller, understood in terms of Christian tradition, that accounts for their decision to begin and to continue this work. (shrink)

Our aims are to set forth a multiprinciple system for selecting among clinical trials competing for limited space in an immunotherapy production facility that supplies products under investigation by scientific investigators; defend this system by appealing to justice principles; and illustrate our proposal by showing how it might be implemented. Our overarching aim is to assist manufacturers of immunotherapeutic products and other potentially breakthrough experimental therapies with the ethical task of prioritizing requests from scientific investigators when production capacity is limited.

Recently there has been a renewed interest in moral inquiry among American scholars in a variety of disciplines. This collection of accessible essays by scholars in philosophy, political theory, psychology, history, literary studies, sociology, religious studies, anthropology, and legal studies affords a view of the current state of moral inquiry in the American academy, and it offers fresh departures for ethically informed, interdisciplinary scholarship. This article explores the role of contract law inintimate relationships, focussing on tacit or onlypartially express agreements rather than expressprenuptial or cohabitation contracts. It welcomes theembrace of relational contract theory by feminist andgay and lesbian commentators, but argues that keydifferences between commercial and intimaterelationships need further analysis if the potentialof relational theory in cases of informal agreement isto be realised. The first difference is that,while commercial contracts can draw on the context ofa contracting community as a source of norms to (...) fillgaps in agreement, there is no equivalent source ofnorms for intimate relationships. The seconddifference is that, although relational theory entailsthe attenuation of self interest in commercialcontracts, in intimate relationships the sense inwhich self interest is attenuated is quite different,with the result that concepts such as cooperation andaltruism have different meanings. The result of thesedifferences is that, in some intimate relationships,there will be informal understandings falling short ofbargain, which will be unenforceable – under bothorthodox contract law and more relationalinterpretations of it. It is argued that many suchinformal agreements are distinguishable from mostgratuitous promises because they are characterised bya degree of reciprocity between the parties. Thepossibility of the law of contract recognising suchnon bargain agreements based on reciprocity isexplored, and it is argued that the enforcement ofsuch agreements represents a less distorting legalresponse than that available through the use ofpromissory estoppel.
